About these terms
These terms cover your use of this website and set out the general terms that apply to work performed by Tex's Digital Services, owned and operated by Ravion Moyers in Cypress, Texas.
Every project also gets its own written agreement covering scope, price, and timeline. Where that agreement and this page disagree, the project agreement wins.
Using this website
You are welcome to browse, read, and use the contact forms. Please do not attempt to disrupt the site, submit automated or fraudulent enquiries, or use it for anything unlawful.
The text, design, code, and layout of this website belong to Tex's Digital Services. Screenshots of client and portfolio projects remain the property of their respective owners and are shown as examples of work performed.
Quotes and pricing
Prices shown on this website are starting points for well defined projects. They are not binding quotes. A binding price comes only in a written proposal for your specific project.
Quotes are typically valid for 30 days. Costs from third parties, such as domains, hosting beyond what is included, platform subscriptions, plugin licenses, payment processing fees, stock assets, and advertising spend, are your responsibility and are billed to your own accounts rather than marked up.
Payment
Project work normally begins with a deposit, with the balance due at launch, unless the project agreement says otherwise. Larger projects may be split into milestone payments.
Recurring plans are billed monthly in advance. Invoices are due on receipt unless stated otherwise in your agreement.
Your responsibilities
Projects depend on a few things from you:
- Providing content, images, and access in reasonable time
- Reviewing work and giving feedback at the agreed points
- Confirming you have the rights to any material you supply
- Providing accurate business information
If a project stalls waiting on materials for more than 60 days, I may pause it and reschedule when you are ready. Work completed to that point remains payable.
Revisions and scope
Each project includes a stated number of revision rounds. Revisions refine what was agreed. A request that changes the agreed scope is additional work, and I will tell you the cost before starting it rather than adding it to an invoice afterward.
Ownership and handoff
On final payment, you own the deliverables created specifically for you, including designs, custom code, and content produced for your project.
This does not transfer ownership of third party components such as open source libraries, licensed fonts, purchased themes, plugins, or stock assets, which remain governed by their own licenses. It also does not transfer general tools, techniques, or reusable components I developed independently of your project.
You may take your project elsewhere at any time. Handoff includes the files and the documentation needed to do that.
Hosting and care plans
Care plans are month to month with no minimum term. Either of us can end one with 30 days notice. If you end a plan, I will provide a copy of your site and reasonable help migrating it.
Included edit time is stated per tier, does not roll over month to month, and is subject to fair use. Work beyond the included time is quoted at the published hourly rate and approved by you before it begins. No plan includes unlimited work.
Plans do not cover recovery from changes made by other parties with access to your site, damage from third party software you install yourself, or rebuilding content lost outside of the backup schedule.
Portfolio use
I may show completed work in this portfolio, including screenshots and a description of what was built. If you would rather your project not appear, tell me and I will leave it out. That request is always honored, and it costs nothing.
What I do not promise
I do not guarantee search rankings, traffic volumes, sales, revenue, or any specific business outcome. Nobody honestly can, and search engines in particular do not sell guarantees to anyone.
Uptime depends in part on infrastructure providers and third party services outside my control. I will monitor, respond, and keep you informed, but I cannot promise a service will never be interrupted.
Limitation of liability
To the extent permitted by law, liability for any claim arising from work performed is limited to the amount you paid for the specific project or, for recurring plans, the amount paid in the preceding three months.
I am not liable for indirect or consequential losses, including lost profits, lost data, or business interruption. You are responsible for maintaining your own independent backups of any business-critical data.
Ending an engagement
Either of us can end a project in writing. If you end one, work completed to that point is payable and I will hand over what has been produced. If I end one, you will receive a refund of any prepaid amount for work not performed.
Governing law
These terms are governed by the laws of the State of Texas. Any dispute will be handled in the courts of Harris County, Texas. I would much rather resolve anything by picking up the phone first.
